2. Scope of the Service

The Ultimate Wedding Game is an interactive quiz-style game designed primarily for weddings and similar events. We provide tools to:

• Create and configure events and game sessions.
• Collect and manage questions and game content.
• Allow guests to join games via phone or other devices.
• Display results live on a screen or projector.

We may update, improve or change parts of the Service over time, including adding or removing features.

3. Who May Use the Service

You may use the Service only if you:

• Are at least 18 years old (or the age of legal majority in your jurisdiction).
• Have the authority to enter into a binding agreement with us.
• Agree to comply with these Terms and all applicable laws and regulations, including data protection and consumer laws where relevant.

Event hosts are responsible for making sure that guests (for example, wedding guests) are informed appropriately about the game and any data processing, in line with our Privacy Policy.

4. Accounts and Access

To create and manage events, you may need to create an account. You are responsible for:

• Providing accurate and up-to-date information during registration.
• Keeping your login credentials secure and confidential.
• All activity that occurs under your account.

You must notify us promptly if you become aware of any unauthorized use of your account or any other breach of security.

5. Plans, Payments and Trials

We may offer a mix of free and paid plans. Details of current plans, prices and included features are provided on our website or within the product.

• Paid subscriptions are typically billed in advance for the selected term (for example, per event or per period).
• Unless otherwise stated, plan fees are non-refundable once the event has taken place or the service period has begun, except where mandatory consumer rights apply.
• We may offer time-limited trials or free tiers which can be changed or discontinued at any time.

Payments are processed by external payment providers. Your use of those services may be subject to their additional terms and privacy policies.

6. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

• Use the Service for unlawful purposes or in violation of any applicable law or regulation.
• Upload or share content that is illegal, hateful, discriminatory, violent, sexually explicit (beyond what is appropriate for an adult wedding context), or otherwise inappropriate.
• Attempt to gain unauthorized access to the Service, other accounts, or underlying systems.
• Reverse engineer, decompile or otherwise attempt to extract the source code of the Service, except where permitted by law.
• Use the Service in a way that could damage, disable, overburden or impair our infrastructure.

We reserve the right to suspend or terminate access if we reasonably believe you are violating these rules.

7. Content and Intellectual Property

You retain all rights to the content you provide to the Service, such as event names, questions, photos and other materials ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process and display your User Content solely for the purpose of operating and improving the Service.

All rights, title and interest in and to the Service itself (including the software, branding, templates, and underlying technology) remain with us and our licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

8. Data Protection and Privacy

Our processing of personal data in connection with the Service is described in our separate Privacy Policy. By using the Service, you acknowledge that we process personal data as set out there.

If you are a host or organizer using the Service for your own guests, you may act as a data controller under applicable data protection law. In that case, you are responsible for ensuring that you have a valid legal basis for processing your guests' data and for providing any required notices to them.

9. Availability and Changes

We aim to provide a reliable and high-quality Service, but we do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable for maintenance, security updates or reasons beyond our reasonable control.

We may modify or discontinue parts of the Service (for example, specific features or plans) to improve the product or respond to market or legal requirements. Where changes materially affect existing paying customers, we will make reasonable efforts to notify you in advance.

10. Warranty Disclaimer

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms is intended to limit any mandatory statutory rights that apply to you as a consumer under the laws of your country of residence.

11. Limitation of Liability

To the extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from:

• Your use of or inability to use the Service.
• Any unauthorized access to or use of our servers and/or any personal data.
• Any interruption or cessation of transmission to or from the Service.

Our total aggregate liability arising out of or relating to the Service and these Terms is, to the extent permitted by law, limited to the amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. This limitation does not apply where prohibited by law, for example in cases of intent, gross negligence or injury to life, body or health under German law.

12. Termination

You may stop using the Service at any time and, where applicable, cancel your subscription according to the cancellation process defined in your plan.

We may suspend or terminate your access to the Service if you materially breach these Terms, use the Service in a way that creates risk or possible legal exposure for us, or if we are required to do so by law. Where reasonable, we will provide prior notice before termination.

13. Governing Law and Dispute Resolution

Unless mandatory consumer protection rules of your country of residence provide otherwise, these Terms are governed by the laws of Germany, without regard to its conflict of law principles.

If you are a consumer residing in the EU, you may also have the right to use the EU online dispute resolution platform or local consumer dispute resolution mechanisms where available. Nothing in these Terms limits any rights you may have under such mandatory rules.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Service or legal requirements. When we make material changes, we will take reasonable steps to notify you (for example, by email or in-app notice) and indicate the date on which the new Terms take effect.

If you continue to use the Service after the updated Terms become effective, you agree to be bound by the revised Terms.
